No responsibility can or will be taken by 30 Knots Spirits if You illegally submit an order. You fully indemnify 30 Knots Spirits against any breach or failure of such confirmation which results in any legal action being taken against 30 Knots Spirits.

5. Orders received through this website are supplied in accordance with the relevant provisions under the liquor licencing laws for each state and territory in Australia.

The Buyer acknowledges and agrees that all Intellectual Property including in the Goods is owned by 30 Knots Spirits, and that the Intellectual Property including in the Goods remains the property of its respective owners and must not be used in any manner without the prior written consent of the owner. The Intellectual Property rights are protected by Australian and international Law and nothing in these Terms of Use gives the Buyer a right to use any of them.

5. Title to the Intellectual Property shall at all times remain with 30 Knots Spirits and nothing contained herein or permitted pursuant to these Terms of Use shall confer upon You any right or property or interest in the Intellectual Property.

6. You acknowledge that to the extent permissible by Law, the Intellectual Property is the exclusive property of, and is owned by, 30 Knots Spirits, if the Goods are transformed or mingled with other goods.

7. You must not at any time, without the prior express written consent of 30 Knots Spirits, apply for registration of any patent, business name, trademark, company name or domain name which includes the Intellectual Property or any part of the Intellectual Property or is substantially similar to the Intellectual Property.

Freight, Insurance and Delivery

1. 30 Knots Spirits will, if requested by the Buyer, at the cost and risk of the Buyer, arrange for the delivery of Goods to the Buyer at the address nominated by the Buyer.

2. Risk in Goods sold by 30 Knots Spirits to the Buyer passes from 30 Knots Spirits to the Buyer upon despatch from the warehouse of 30 Knots Spirits.

3. 30 Knots Spirits has no obligation to arrange for insurance of Goods against the risks of carriage.

4. If 30 Knots Spirits agrees to arrange freight and insurance, or both, in respect of any Goods sold or supplied by 30 Knots Spirits to the Buyer, the Buyer must pay and reimburse 30 Knots Spirits for all such costs.

5. 30 Knots Spirits shall not be liable for any loss or damage due to any failure by 30 Knots Spirits to deliver any Goods promptly, or at all.

6. Delivery dates or times indicated by 30 Knots Spirits to the Buyer are approximate only and do not constitute a guarantee of delivery or delivery by such date or time. No time of the essence transaction will be considered by 30 Knots Spirits unless agreed in writing by 30 Knots Spirits.

7. Subject to these Terms of Use, no Goods shall be placed on Back Order.

8. Goods may be placed on Back Order if agreed in writing by 30 Knots Spirits. Those Goods shall be supplied by 30 Knots Spirits as soon as reasonably practicable upon 30 Knots Spirits receiving those Goods.

9. 30 Knots Spirits may, in the sole discretion of 30 Knots Spirits, delay delivery of any Goods until 30 Knots Spirits has received payment from the Buyer of all money due by the Buyer to 30 Knots Spirits in respect of those Goods and any other Goods previously sold by 30 Knots Spirits to the Buyer.

Claims, Returns or Cancellations of Orders

1. The Buyer has no right to cancel, or vary, any order for Goods after 30 Knots Spirits has accepted that order.

2. If for any reason 30 Knots Spirits permits the Buyer to cancel an order for Goods, the Buyer must pay 30 Knots Spirits a fee equivalent to twenty five percent (25%) of the price for those Goods that would, apart from cancellation of the order, be payable by the Buyer to 30 Knots Spirits.

3. Risk and title in the goods passes to the buyer upon dispatch of the goods from 30 Knots Spirits Licenced Premises at 166 Chapman Road, Beresford, Western Australia 6530. If at any time the buyer is not satisfied with the quality of the liquor purchased, the buyer may contact 30 Knots Spirits and a nominated representative will assess a request for a credit or refund of the purchase price.

Online Orders

1. The buyer (or their agent) must sign for the receipt of delivery. Anyone at the delivery address who receives the goods shall be presumed by 30 Knots Spirits to be authorised to receive the goods on the buyer’s behalf.

2. If the address for delivery is within Australia, the goods are most likely to be delivered by Australia Post and can reasonably be expected to arrive within 7-14 working days, however from time to time there may be delays throughout the postal network that are outside of our control.

3. Prices for liquor delivered within Australia include Australian Government Excise and Goods and Service Taxes. 30 Knots Spirits will not be liable for cost or inconvenience transpiring from the sale of liquor to a location within Australia where the sale of liquor is restricted or prohibited.

Gift Vouchers

1. Gift Vouchers are available for purchase at the Distillery or online via our website,

2. The value of the Gift Voucher will be the value at the time of purchase. Online purchased Gift Vouchers will be sent to you as soon as practicable by email and within 5 working days of your payment being received. Responsibility for loss of the Gift Vouchers and protection of the valid voucher number passes to the purchaser as soon as it has been delivered. We are not responsible for the loss of a Gift Voucher that is undeliverable due to your failure to enter an accurate delivery address.

3. Gift Vouchers cannot be redeemed at the online store.

4. Gift Vouchers may not be returned, redeemed for cash or cancelled and will not be refunded.

5. Gift Vouchers can be used to purchase any goods for sale at our Distillery.

6. The full value of the Gift Voucher must be used before the ‘Expiry Date’.

7. We reserve the right to change these Terms and Conditions from time to time at our discretion.
